President’s Report: Michael Callaghan
Liability Insurance: This issue was last looked at by Rod Barret and the committee in 2023. They looked at legislation, assessed the risks and at least 2 members of the club obtained verbal advice from lawyers. It was unanimously decided there was no need for insurance coverage. The reasoning behind this decision in 2023 was because there is protections for members and committees within incorporated club as per the incorporated clubs Act 2009. Additionally, the Civil Liabilities Act 2002 has protections of liability when persons indulge in activities that are risky especially when warned beforehand.
The question has been raised again by committee member Richard Robertson during the last committee meeting. Regardless of the manner it has surfaced it needs to be looked at again and needs to be resolved indefinitely so we can put it to bed.
Richard Robertson explained to the attending members the reasoning behind bringing this issue up again mainly due to the recent incidents and hospitalisations. Richard also investigated Motorcycling Australia coverage.
John Ogden spoke of his opinion and read the relevant clause/s of the Act that explains the protections of liability for committee and members of an incorporated club.
Dave Henderson explained that the green slip on his motorcycle registration covered his needs during his recovery.
Paul Reiley spoke about improving club policy of dealing with bad behaviour on rides and documenting reprimand showing the club has been pro active and has evidence in the event of a claim.
Mick Dubokovich spoke of the classic motorcycle clubs in Broken Hill and how they have an affiliation with the Historic Motoring Association and Council of Historic Motor Clubs. Mick also explained one of the clubs which has 80 members only pays $1100 per annum and a small dollar figure per member. It was also noted that liability coverage also covers persons inspecting classic bikes for club rego.
Rod Broadhead is heavily involved with Bundanoon RSL. He states that we as a club need insurance coverage as does the RSL.
A vote was put to the attending members for the below options:
Option 1: We accept the previous resolution that there is not a need for public liability insurance. Pros: No disruption of activities. Cons: The issue is not going away.
Option 2: We accept the treasurers (Richard Robertson) recommendation to get insurance through Motorcycling NSW as this is acknowledging we have a liability issue. All club activities are suspended until insurance coverage is in place.
Pros: Minimal down time. Cons: Expensive, $114 per organised ride.
Option 3: The committee asks for more time to investigate, seek paid legal advice and see what options are out there for public liability insurance that suites our club that is affordable.
Pros: Legal advice tailored to suit our club needs. If we need insurance we can look for a suitable provider. Close out the issue of insurance once and for all.
Cons: All club activities to be suspended until issue is resolved. Will need to pay for a solicitor.
Vote:
Option 1: 5 hands
Option 2: 1 hand
Option 3: 33 hands
Outcome was option 3. All club activities suspended until further notice. Updates will be provided via club email when committee has news.
